Cohabitation

Cohabitation Lawyers

It is not unusual for couples to live together without ever getting married or entering into a civil partnership. Marriage is not for everyone. There are however big legal differences between co-habitation and marriage which you should be aware of.

The media have invented a term Common Law Husband and Wife which does not exist in English Law. If you live together in England and Wales and are not married, your relationship is one of cohabitee.

The difficulty for co-habiting couples is that the law does not recognise it and therefore important legal matters such as ownership of property, your will, and your pension could be overlooked at the worst possible time. This is particularly relevant if as a co-habiting couple you have children together.

Cohabitation Solicitors

Lloyd Platt & Company responsible for ground breaking law in relation to the rights of co-habitees where there are children involved. In particular, in relation to the appropriate housing that can be obtained during the child's minority or the amounts of carer allowance.

On the breakdown of such a relationship there is a complex web of laws covering this area. Lloyd Platt & Company specialises in advising parties on cohabitation agreements so that these difficulties can be avoided. We also advise on settlements of such disputes or in taking matters to Court and cutting through the complex regulations.

If you have chosen not to marry or enter a civil partnership it is our advice that you take some time and seriously consider what is to be done should one of you die, fall seriously ill or the relationship comes to separation.

Lloyd Platt & Company are specialist divorce solicitors and experts in family law, adoption, children's matters, civil partnerships, co-habitation, domestic violence, financial settlements on divorce and pre-nuptial agreements.
